These Terms of Use form a legally binding agreement between you and FLICKNMIX LTD. By downloading, registering for, or using the ZYMIX app or website, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree, please do not use ZYMIX.

You must be 16 or over to use ZYMIX. If you are under 16, please do not register or use the platform.

1. About These Terms

These Terms of Use (the 'Terms') govern your use of the ZYMIX app, website (www.zymix.ai), and any related services provided by FLICKNMIX LTD (together, the 'Platform'). They form a legally binding agreement between you and FLICKNMIX LTD.

These Terms should be read alongside our Privacy Policy and Community Guidelines, which are incorporated into these Terms by reference. Where there is any conflict, these Terms prevail.

We may update these Terms from time to time. Where we make material changes, we will notify you through the Platform before those changes take effect. Your continued use of the Platform after that date means you accept the updated Terms. If you do not agree, you should stop using the Platform and, if you wish, delete your account. Where a change is minor, we may make it without prior notice; your continued use of the Platform following any such change constitutes your acceptance of it.

2. Eligibility and Account Registration

2.1 Minimum age

You must be at least 16 years old to use ZYMIX. By registering, you confirm that you meet this requirement. If we discover that a user is under 16, we will suspend and delete their account without notice.

In some jurisdictions, a higher age may be required for certain features — for example, where local law requires parental consent for users under a specific age. Where applicable law imposes a higher minimum age for any feature, that higher age applies.

We currently rely on users declaring their age at registration. We do not operate a formal age verification system at this stage. We are actively exploring proportionate age assurance solutions and will implement them as the Platform develops.

Users who register as aged 16 or 17 will be asked to confirm at registration that a parent or guardian is aware of their use of ZYMIX. This acknowledgement is part of our commitment to the safety of younger users and is required to complete registration.

2.2 Account registration

To access most features of the Platform, you will need to create an account. When registering you agree to:

  • provide accurate, current, and complete information, including your phone number;
  • keep your registration information up to date;
  • keep your account credentials secure and not share them with anyone else; and
  • notify us immediately at support@flicknmix.io if you suspect your account has been compromised.

You are responsible for all activity that takes place through your account. We are not liable for any loss or damage arising from your failure to keep your account secure.

2.3 One account per person

You may only hold one ZYMIX account. Creating accounts on behalf of others, or registering with false information, is a violation of these Terms and may result in immediate suspension or termination.

2.4 Account deletion

If you want to delete your account, go to Me > Account > Delete Account within the app, or contact us at support@flicknmix.io. Once deleted, you will not be able to recover your account or any content associated with it. Some information may be retained after deletion where we are legally required or permitted to do so — see our Privacy Policy for details.

3. The Platform and Our Services

3.1 What ZYMIX provides

ZYMIX is a social and community platform. We provide tools and features that allow you to:

  • create a profile and interact with other users;
  • post, share, and discover user-generated content including text, photos, audio, and video;
  • send and receive messages;
  • participate in events, communities, and groups;
  • use location-based and proximity discovery features where you choose to enable them;
  • receive personalised content recommendations; and
  • access creator monetisation and payment features where available.

The Platform is evolving. We may add, modify, or withdraw features at any time. We will use reasonable efforts to notify you of significant changes.

3.2 Recommendation systems

ZYMIX uses automated recommendation systems to personalise the content, people, and events shown to you on the Platform. These systems analyse your activity — including the content you engage with, your interactions, and your usage patterns — to predict what you are likely to find relevant. This involves a form of automated profiling.

You can find more detail about how our recommendation systems work in our Privacy Policy. You have the right to object to profiling — see Section 13 and our Privacy Policy for how to exercise that right.

3.3 Location and nearby discovery

ZYMIX currently offers, and plans to develop further, features that allow you to discover users or content near you. These features are always opt-in. We will request your permission before activating any location functionality, and you can disable location access at any time through your device settings or within the app.

Please think carefully before enabling location features. Once your location is active within a feature, other users within that feature may be able to see that you are nearby.

3.4 Paid services and payments

ZYMIX offers payment functionality for selected categories. Payments are processed by our payment service provider, Mangopay UK Limited. By using payment features, you also agree to Mangopay's terms of use, available at mangopay.com. We are not responsible for the payment processing services provided by Mangopay beyond our own obligations under applicable law.

To use payment services, you may need to complete identity verification (KYC) checks required by Mangopay. Refusal to complete these checks may result in suspension of payment functionality.

We do not guarantee instant settlement. Delays may occur due to banking procedures, compliance checks, or technical issues. We are not liable for delays or errors caused by third-party payment systems, except to the extent required by applicable law.

3.5 Third-party links and services

The Platform may contain links to third-party websites, apps, or services. We do not control those third parties and are not responsible for their content, privacy practices, or terms. Accessing a third-party service through ZYMIX is at your own risk.

4. Your Content

4.1 What is user content

'User Content' means anything you create, upload, post, share, transmit, or store through the Platform, including text, photos, images, audio, video, messages, and any other material you contribute.

4.2 Your responsibility for your content

You are solely responsible for your User Content. By posting User Content, you confirm that:

  • you own it or have all necessary rights and permissions to post it;
  • posting it does not infringe any third party's intellectual property, privacy, or other rights;
  • it complies with these Terms, our Community Guidelines, and applicable law; and
  • it is accurate and not misleading.

We do not endorse any User Content, and we are not responsible for the accuracy, completeness, or legality of content posted by users.

4.3 Licence you grant to ZYMIX

By posting User Content on the Platform, you grant ZYMIX and its affiliates a non-exclusive, royalty-free, worldwide, transferable, sub-licensable licence to use, store, copy, adapt, modify, distribute, publish, translate, perform, and display that content for the purposes of operating, providing, improving, and promoting the Platform.

This licence is limited to what is necessary to operate the Platform. You retain ownership of your User Content. This licence ends when you delete your content or account, except where: (a) your content has been shared by others and they have not deleted it; (b) we are required by law to retain it; or (c) removal is technically impractical within a reasonable timeframe.

You can delete your User Content at any time through the Platform. Some cached or archived copies may persist for a limited period after deletion for technical reasons.

4.4 ZYMIX content and intellectual property

All content, software, design elements, graphics, trademarks, logos, and other materials provided by ZYMIX on the Platform are owned by or licensed to FLICKNMIX LTD and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use ZYMIX's intellectual property without our prior written consent.

5. Acceptable Use

5.1 What you must NOT do

By using the Platform, you agree NOT to:

  • post, share, or transmit content that is illegal, defamatory, obscene, threatening, abusive, harassing, or that incites violence or hatred;
  • post, share, or transmit child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors — this will result in immediate termination and referral to law enforcement;
  • engage in grooming, exploitation, or any conduct intended to manipulate or cause harm to younger users or any vulnerable person;
  • stalk, harass, intimidate, or bully any user;
  • use the Platform to facilitate or promote self-harm, eating disorders, or suicide;
  • impersonate any person or entity, or falsely claim an affiliation with any person or entity;
  • register an account with false information, or create an account on behalf of another person without their authorisation;
  • attempt to access another user's account without permission;
  • use the Platform to commit fraud or facilitate fraudulent transactions;
  • attempt to reverse engineer, decompile, or extract the source code of the Platform or any part of it, except where expressly permitted by applicable law;
  • upload or transmit malware, viruses, spyware, or any other harmful or malicious code;
  • interfere with or attempt to disrupt the Platform's servers, networks, or infrastructure;
  • attempt to circumvent any content filtering, moderation, or security measures we employ;
  • use automated tools, bots, scrapers, or scripts to access, collect data from, or interact with the Platform without our prior written consent;
  • manipulate engagement metrics, including through artificial amplification, vote manipulation, or coordinated inauthentic behaviour;
  • collect, harvest, or attempt to collect personal information about other users without their consent;
  • use the Platform to send unsolicited commercial messages (spam);
  • misuse location or proximity features to track, monitor, or surveil other users without their knowledge or consent;
  • attempt to manipulate or game ZYMIX's recommendation systems, algorithms, or content ranking mechanisms;
  • use the Platform for any purpose that competes with or undermines ZYMIX's business, without our prior written consent;
  • use the Platform in any way that violates applicable law, including data protection, consumer protection, and intellectual property law.

5.2 Consequences of misuse

We take violations of these Terms seriously. Depending on the nature and severity of the violation, we may:

  • remove or restrict the relevant content or feature;
  • issue a warning to your account;
  • temporarily suspend your account;
  • permanently terminate your account;
  • report the conduct to law enforcement or regulatory authorities; and/or
  • take legal action.

For the most serious violations — including CSAM, grooming, exploitation of minors, and conduct posing an immediate safety risk — we will act without warning and will report to appropriate authorities.

6. Moderation and Safety

6.1 Our approach to moderation

We use a combination of automated AI tools and human moderators to review content on the Platform and to enforce our Community Guidelines and these Terms. In practice, this means:

  • AI tools automatically scan content — including text, photos, audio, and video — for potential violations, harmful material, and illegal content;
  • Human moderators review content flagged by automated systems, handle serious or disputed cases, and respond to user reports;
  • Serious safety concerns, including potential illegal content or safeguarding risks, are escalated to appropriate internal teams and, where required, to law enforcement or regulatory authorities.

We do not guarantee that all content on the Platform will be reviewed before it is posted, or that our moderation systems will detect every violation. We are a platform, not a publisher, and our moderation activities do not create any editorial responsibility for User Content.

6.2 AI-assisted moderation

Our content moderation includes AI-powered tools that process User Content to detect potential violations at scale. These tools are used alongside human review. Content you post may be assessed by automated systems as part of our safety operations. We will notify you if a significant moderation decision is taken against your account and explain the basis where we are able to do so.

6.3 Reporting harmful content

You can report content or users you believe are violating these Terms or our Community Guidelines using the reporting tools within the app. We take all reports seriously and will review them in accordance with our internal processes. We may not be able to disclose the outcome of a specific report where doing so would affect the privacy of another user or an ongoing investigation.

6.4 Moderation decisions and appeals

Where we remove content, restrict a feature, or suspend or terminate an account, we will make reasonable efforts to notify you of the decision and the reason for it, except where doing so would compromise a safety investigation or is otherwise prohibited.

We provide an appeals process for moderation decisions through the Platform. Details of the appeals process are available within the app. We will review appeals fairly and in a reasonable timeframe.

6.5 UK Online Safety Act

ZYMIX is a user-to-user service subject to the UK Online Safety Act 2023. We have legal duties relating to illegal content, children's safety, user reporting, and transparency, which we are actively implementing. Details of our online safety practices are available within the Platform.

6.6 EU Digital Services Act

Where ZYMIX is accessible to users in the EU, the EU Digital Services Act (DSA) applies. This includes obligations relating to content moderation, recommender system transparency, and user redress. We are working towards full DSA compliance and will provide relevant information within the Platform.

7. Younger Users (Aged 16–17)

If you are 16 or 17 years old, this section applies to you.

You must be 16 or over to use ZYMIX. If you are under 16, do not use the Platform.

We take the safety and privacy of younger users seriously. ZYMIX is designed with the requirements of the UK Age Appropriate Design Code (AADC) and the UK Online Safety Act in mind.

7.1 Protections in place

  • Our minimum age is 16. Accounts found to belong to under-16s will be deleted without notice.
  • At registration, users aged 16 or 17 are asked to confirm that a parent or guardian is aware of their use of the Platform. This creates a documented record of awareness and forms part of our safeguarding framework for younger users.
  • Content reporting tools are available within the app so you can flag anything that makes you uncomfortable.
  • Our moderation team treats reports and concerns involving younger users as a priority.
  • Our Community Guidelines explicitly prohibit harassment, grooming, exploitation, and any conduct that could cause harm to younger users.

7.2 Platform design for younger users

We design the Platform with the UK Age Appropriate Design Code in mind. We are developing protections specifically for users aged 16 and 17, including in relation to privacy settings, recommendation systems, and location features. We will update these Terms and our Privacy Policy as those developments are implemented.

7.3 Guidance for younger users

If you are 16 or 17, we encourage you to review your privacy settings carefully, keep location features switched off unless you actively choose to use them, and use the reporting tools if anything makes you uncomfortable. You can contact us directly at privacy@flicknmix.io.

If you are a parent or guardian with concerns, or if you believe someone under 16 is using the Platform, please contact us at privacy@flicknmix.io. We will investigate promptly.

8. Discoverability and Location Features

8.1 What you should know

ZYMIX includes social discovery features. Depending on your settings, your username, profile photo, and public content may be visible to other users and, in some cases, searchable. You can control your visibility through your privacy settings within the app.

Location and proximity features are always opt-in. We request your explicit permission before activating any location feature. Once active, other users within that feature may be able to see that you are nearby.

8.2 Your responsibilities

By enabling discoverability or location features, you acknowledge that:

  • your profile or approximate location may be visible to other users;
  • you should exercise appropriate caution in how you interact with other users you discover through these features; and
  • you can disable these features at any time through your settings or device privacy controls.

ZYMIX is not responsible for how other users respond to your presence on the Platform, including through location or proximity features, beyond our moderation and safety obligations.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains in detail what personal information we collect, why we collect it, how we use it, who we share it with, and what rights you have. The Privacy Policy is incorporated into these Terms by reference.

By using the Platform, you acknowledge that you have read and understood our Privacy Policy. Where there is any conflict between these Terms and the Privacy Policy on a data protection matter, the Privacy Policy prevails.

Our Privacy Policy is available at www.zymix.ai/en/privacy.html and within the app.

10. Disclaimers and Limitation of Liability

10.1 Platform provided as is

The Platform is provided on an 'as is' and 'as available' basis. To the fullest extent permitted by applicable law, we make no representations or warranties of any kind — express or implied — about the operation, availability, accuracy, or fitness for purpose of the Platform or any content on it.

We do not warrant that:

  • the Platform will be available at all times or free from interruption or errors;
  • any content on the Platform is accurate, complete, or up to date;
  • the Platform is free from viruses or other harmful components; or
  • the Platform will meet your particular requirements or expectations.

10.2 User Content disclaimer

We do not endorse, verify, or take responsibility for any User Content posted by users. Statements, opinions, and information expressed by users are their own and do not represent the views of ZYMIX. Your interactions with other users are at your own risk.

10.3 Limitation of liability

To the fullest extent permitted by applicable law, FLICKNMIX LTD's total liability to you in connection with the Platform — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the greater of: (a) the total fees paid by you to ZYMIX in the 12 months preceding the claim; or (b) £500.

To the fullest extent permitted by applicable law, we shall not be liable for:

  • any indirect, incidental, special, consequential, or punitive loss or damage;
  • loss of profits, revenue, business, data, or goodwill;
  • loss or corruption of content or data;
  • any harm caused by User Content posted by other users; or
  • any interruption or unavailability of the Platform.

10.4 What this does not affect

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any other liability that cannot lawfully be excluded or limited under applicable law, including your statutory consumer rights.

10.5 Force majeure

We are not liable for any failure or delay in providing the Platform caused by circumstances beyond our reasonable control, including natural disasters, pandemic, power failures, internet outages, acts of government, or third-party service failures. We will take reasonable steps to minimise the impact on users where possible.

11. Suspension and Termination

11.1 Our rights

We reserve the right to suspend or terminate your account, or restrict your access to any part of the Platform, at any time and without prior notice where we reasonably consider that:

  • you have violated these Terms or our Community Guidelines;
  • your conduct poses a risk to the safety of other users or to the integrity of the Platform;
  • you have provided false information in connection with your account;
  • we are required to do so by law or regulatory authority; or
  • we are unable to continue providing the Platform to you for technical or legitimate business reasons.

For serious violations — including CSAM, grooming, exploitation, and conduct posing an immediate safety risk — suspension or termination will be immediate and without warning.

11.2 Effect of termination

On termination of your account:

  • your right to access and use the Platform ceases immediately;
  • we may delete your account and associated content, subject to any legal retention obligations;
  • any licences you have granted to ZYMIX will continue to the extent necessary to comply with legal obligations or to address content shared by other users before termination.
  • Termination does not affect any accrued rights or remedies of either party.

11.3 Your right to close your account

You may close your account at any time through the app (Me > Account > Delete Account) or by contacting us at support@flicknmix.io. Closing your account does not entitle you to any refund of purchases made, except where required by applicable law.

12. Sanctions and Restricted Territories

We do not accept payments from, or conduct business with, individuals or entities in Cuba, Iran, North Korea, Sudan, Syria, or the Crimea region. Users in those jurisdictions may be unable to access the Platform or certain features. We reserve the right to restrict access from additional territories where required by applicable law or regulatory guidance.

13. Your Rights and How to Contact Us

Your data protection rights — including the right to access, correct, delete, and object to processing of your personal information — are set out in our Privacy Policy. To exercise any of these rights, contact us at privacy@flicknmix.io.

To make a complaint about the Platform, content, a moderation decision, or these Terms, contact us at support@flicknmix.io. We will acknowledge your complaint and respond within a reasonable timeframe.

For legal requests, law enforcement enquiries, or requests for user information, please contact us through FLICKNMIX LTD at the address below using the appropriate legal process. We will not respond to informal or improperly served legal requests.

14. Governing Law and Disputes

14.1 Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. If you are a consumer resident in the UK or EU, you retain the benefit of any mandatory consumer protection provisions under the law of your country of residence that cannot be excluded by contract.

14.2 Resolving disputes

If you have a complaint, please contact us first at support@flicknmix.io. We will try to resolve your concern promptly and fairly. If we are unable to resolve it, you may refer the matter to the courts of England and Wales.

15. General

15.1 Entire agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and FLICKNMIX LTD in relation to your use of the Platform and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15.3 No waiver

Our failure to enforce any provision of these Terms at any time does not constitute a waiver of our right to enforce it in the future.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or successor entity in connection with a merger, acquisition, or sale of assets.

These Terms are written in English.
